§ 31A.08. Notice of Hearing Concerning Permit Revocation.

  • Whenever the city council shall find any of the conditions enumerated in section 31A.07 hereof to exist, it shall notify the permittee that city council shall hold a public hearing to determine whether the continued operation of the permitted premises is detrimental to the public health, morals, safety and welfare. In determining whether the continued operation of the permitted premises is detrimental to the public health, morals, safety and welfare, city council shall consider whether the condition(s) enumerated in section 31A.07 which are found to exist are related to the use or operation by the permittee or an interested party thereof of the permitted premises and if such condition(s) evidences a flagrant disregard for the health, morals, safety or welfare of such permittee's patrons or employees, or of persons residing or doing business nearby. If city council determines that a condition enumerated in section 31A.07 does exist as to a permitted premises and that such condition relates to the use or operation by the permittee or of an interested party thereof of the permitted premises and that such condition evidences a flagrant disregard for the health, morals, safety or welfare of such permittee's patrons or employees or of persons residing or doing business nearby, city council shall revoke the permit of the permittee. If city council determines that no conditions enumerated in section 31A.07 exist as to a permitted premises, or that no such existing condition relates to the use or operation by the permittee or an interested party thereof of the permitted premises, or that no such existing condition evidences a flagrant disregard for the health, morals, safety or welfare of such permittee's patrons or employees, or of persons residing or doing business nearby, city council shall not revoke the permit of the permittee. Such hearing is to be held at a time and place to be specified in the notice and at a time not less than ten (10) days from the date of service of the notice. Such notice shall also list with specificity the acts or occurrence concerning which the hearing will be held.
