Department Heads, which is hereinafter defined to include their designee(s), having
jurisdiction over land development regulations, and engineering codes, ordinances,
regulations, or resolutions, shall have the authority to grant waivers or exceptions,
or, if City Code so provides and a waiver or exception is not available, to seek variances,
to and from applicable City Codes, ordinances, regulations, or resolutions. Such authority
is conditioned upon a determination that the waiver, exception, or variance does not
adversely affect the public health, safety or welfare. This determination shall be
made in writing with copies distributed to the Office of Legal Affairs, The Real Estate
Department, and the Office of Permitting Services.
