The Proportionate Fair-Share Program shall apply to all developments in the City that
have been notified of the City's determination of a lack of capacity to satisfy transportation
concurrency on one or more transportation facilities under the City Concurrency Management
System (CMS), including transportation facilities maintained by the Florida Department
of Transportation (FDOT) or other jurisdictions or agencies, whose facilities are
relied upon by the City for concurrency determinations, pursuant to the requirements
of this Chapter. The Proportionate Fair-Share Program does not apply to Developments
of Regional Impact (DRIs) using proportionate fair-share under F.S. § 163.3180(12),
or to developments exempted from concurrency as provided in Part 1 of this Chapter,
and F.S. Chapter 163.3180, regarding exceptions and de minimis impacts.
