§ 59.801. When Concurrency Resolution Procedures Apply.

The Concurrency Resolution procedures described in this Part shall apply when:
(a)

A Concurrency Encumbrance Denial Letter has been issued pursuant to Part 5 of this Chapter; or

(b)

The Annual Capacity Availability Report set forth in Part 7 of this Chapter indicates that any public facility or service is not available to serve the proposed development.
