§ 65.321. Authorization.
Appeals of Zoning Official's Determinations. The Board of Zoning Adjustment shall have the power and duty to hear and decide appeals when it is alleged that there is error in any order, requirement, decision, or determination made by the Zoning Official in the enforcement of this Chapter, except as may be specifically provided otherwise by Court, law, rule, regulation, or this Chapter.
Appeals of Planning Official's Determinations. The Municipal Planning Board shall have the power and duty to hear and decide appeals when it is alleged that there is an error in any order, requirement, decision, or determination made by the Planning Official in the enforcement of this Chapter, except as may be specifically provided otherwise by Court, law, rule, regulation, or this Chapter.
Appeals of Appearance Review Official's Determination. The Board of Zoning Adjustment shall have the power and duty to hear and decide appeals when it is alleged that there is error in any order, requirement, decision, or determination made by the Appearance Review Official in the enforcement of this Chapter, except as may be specifically provided otherwise by Court, law, rule, regulation, or this Chapter.
Scope of Authority upon Appeal. In exercising its powers, the Board of Zoning Adjustment or Municipal Planning Board may, upon appeal and in conformity with this Ordinance, reverse or affirm, wholly or partly or may modify the order, requirement, decision, or determination made by the administrative official from said appeal.
