§ 65.395. The Review Process.

  • Technical Review Committee. Upon acceptance of the application, copies shall be forwarded to all members of the Technical Review Committee (TRC). The TRC shall meet to review the application, and the applicant or his representative should also be present at the meeting. Following this meeting, the TRC shall prepare recommendations for the consideration of the Municipal Planning Board.

    Municipal Planning Board. The Municipal Planning Board, acting as the Local Planning Agency, shall hold a public hearing with due public notice to consider the application. Based on the application, the requirements of this Chapter, and the recommendations of the staff, the Board shall prepare recommendations for the consideration of the City Council.

    City Council. The recommendations of the Municipal Planning Board shall be forwarded to the City Council for final review and approval or denial. The City staff shall initiate the preparation of the ordinance amending the Growth Management Plan. The City Clerk shall schedule the ordinance for legal hearings to be held by City Council and the hearings shall be held and advertised in accordance with the requirements of Florida Statutes § 163.3187.

    Conformance with Procedural Requirements of Florida Statutes § 163.3187 and F.A.C. ch. 9J-11. Growth Management Plan amendments shall be processed in accordance with the procedural requirements of Florida Statutes § 163.3187 and F.A.C. ch. 9J-11.

    Reapplication Time Limit. Unless specifically permitted otherwise by City Council, no application for any Growth Management Plan amendment shall be considered by the Municipal Planning Board within one year from the time the property described in such application has been decisively acted upon by the City Council as a result of a previous application.

    Recording Amendment to the Official Future Land Use Map Series. On the effective date of any Official Future Land Use Map Amendment the change shall be posted on the Official Future Land Use Map by the Planning Official and records accompanying the map shall identify the official action by which such amendment was made, the date of such action, and the area involved. Unless otherwise specified, all such amendments shall be deemed to include one-half of all streets, railroad tracks, or other similar natural or man-made features abutting the land use changes, wherever such features are located within the City Limits of Orlando and as determined by the Planning Official.
