§ 65.464. Revocation or Suspension of a Certificate of Use.

  • A certificate of use may be suspended or revoked by the City on any of the following grounds:

    1.

    The owner/applicant misrepresented or omitted material facts or information on the certificate of use application; or

    2.

    The owner/applicant, as part of the owner/applicant's business activity, violated city, county or state laws for the protection of public health, safety or welfare, and it is determined by the City that the continuation of the business activity would be detrimental to the public health, safety or welfare; or

    3.

    The certificate of use issued depended upon the owner/applicant's compliance with specific provisions of city, county or state laws and the owner/applicant violated such specific provisions of law; or

    4.

    The owner/applicant violated any provision of this section and failed or refused to cease the violation thereof; or

    5.

    The premises are condemned by the local health authority for failure to meet sanitation standards or the premises are condemned by the local authority having jurisdiction because the premises are unsafe or unfit for human habitation; or

    6.

    The owner/applicant fails to supply the City the reasonable records requested by the City for purposes of ensuring and confirming continued compliance with representations made to the City when such business applied to the city for land use or zoning approval.
