§ 65.504. The Review Process.

  • Technical Review Committee. Copies of the application for abandonment shall be forwarded to all members of the Technical Review Committee for review. The Planning and Development Department will review the application for consistency with the requirements of State Law, the Provisions of this Part, and all other applicable provisions. The Technical Review Committee (TRC) shall meet to review the application, and the applicant or his representative should also be present at the meeting. Following the meeting, the TRC shall prepare recommendations for the consideration of the Municipal Planning Board (MPB).

    Municipal Planning Board (MPB). The Municipal Planning Board shall hold a public hearing with due public notice to consider the application. Based upon the application, the requirements of this Chapter, and the recommendations of staff, the Board shall recommend approval, denial, approval with conditions of modifications, or refer the matter back to the Technical Review Committee for further consideration based on specific instructions.

    City Council Review. The recommendations of the Municipal Planning Board shall be submitted to the City Council for final review and approval or denial. The City staff shall initiate the preparation of the necessary ordinance. The City Clerk shall schedule and advertise the ordinances for legal hearings to be held by City Council. City Council shall hold two (2) legal hearings/readings of the ordinances. No less than 10 days prior to the first meeting of the City's Municipal Planning Board, at which the Abandonment Ordinance will be heard, the City shall post a Notice of Abandonment at a conspicuous location along the right-of-way that is proposed to be abandoned. The Notice shall provide a brief description of the right-of-way proposed to be abandoned and the anticipated date, time, and location of the Municipal Planning Board meeting. Upon completion of the second reading and adoption, the ordinance shall become effective as specified therein.
