§ 65.513. Review Procedures for Applications for Minor Certificates of Appearance Approval.

  • Applications for minor certificates of appearance approval are subject to review by the Appearance Review Official. Within 15 days of receiving a complete application, the Appearance Review Official must provide the applicant with a written decision indicating approval of the application as submitted, approval of the application with conditions as provided, or denial of the application.

    Approval as submitted. If the application is approved as submitted, the Appearance Review Official must issue the certificate of appearance approval within five days of approval.

    Approval with conditions. If the application is approved with conditions, the Appearance Review Official must issue the certificate of appearance approval, including the written conditions of approval, within five days of approval. If the applicant objects to one or more of the written conditions of approval, the applicant may, within five days of the certificate being issued, request that the application be reconsidered by the ARB. Such request must be in writing to the Appearance Review Official. The Appearance Review Official must refer the application to the next available regular meeting of the ARB and must provide the ARB with a report in the same manner as if the application was being reviewed as an application for major certificate of appearance approval.

    Denial. If the application is denied, the Appearance Review Official must provide written reasons for the denial along with the notice of denial, and the applicant may, within five days of the application being denied, request that the application be reconsidered by the ARB. Such request must be in writing to the Appearance Review Official. The Appearance Review Official must refer the application to the next available regular meeting of the ARB and must provide the ARB with a report in the same manner as if the application was being reviewed as an application for major certificate of appearance approval.
