§ 65.536. Conversion of Uses.

  • Any party seeking to convert development capacity between use categories in the manner described in the DDRI development order shall so indicate in an application for Individual Development Approval.

    The Planning Official or his designees shall have discretion to approve or disapprove conversion based upon the compatibility of the proposed development with the overall goals and policies of the DDRI and the Growth Management Plan. The Planning Official's determination is appealable pursuant to Chapter 65, Part 2G of this Code by the applicant or any party with a pending application for Individual Development Approval.

    An additional conversion fee in an amount to be set from time to time by resolution of the City Council shall be paid in to a trust fund to be called the DDRI Conversion Trust Fund. The City of Orlando shall use said funds for land acquisition or capital improvements for roads, mass transit, public parking, parks, and recreation to offset the effects of conversion of uses, to be allocated on a case-by-case basis as approved by the City Council upon the recommendation of the Director of the Department.
