§ 65.574. Performance Guarantee for Certain Improvements.
(A)
When Performance Guarantee Required. The Public Works Director may permit the developer/builder to provide a performance guarantee and an agreement to delay the installation of the following improvements:
(1)
Improvements within public rights-of-way.
(2)
Installation of sidewalks and bikeways.
(3)
Improvements to major drainage ways.
(4)
Provision of recreational facilities in lieu of recreational open space.
(B)
Timing of Performance Guarantee. The performance guarantee and agreement shall be provided to the City prior to the issuance of any Certificate of Occupancy, and except for the effective period, shall be subject to all of the performance guarantee requirements of Part 5C of this Chapter. During installation of the improvements, the developer/builder shall be subject to all of the requirements of Parts 5C and 5D of this Chapter pertaining to the construction, inspection and completion of such improvements.
