§ 65.583. Failure to Maintain Common Improvements and Open Space.

  • Failure to maintain common improvements and/or common open space in accordance with this Code, established City standards, the developer's agreements, and/or other documents establishing the improvements and/or open space shall be considered a violation of this Code subject to enforcement in accordance with Chapter 5 of this City Code. In such cases, citations of violation shall be issued both to the organization or entity, and to all property owners, occupants and lessees having beneficial use of or legal interest in the improvements and/or open space. The City shall not be required or obligated in any way to construct or maintain, or participate in any way in the construction or maintenance of the common improvements and/or open space.
