§ 65.591. The Review Process.

  • The City Engineer shall not issue or approve any permit for the purposes set forth above, unless and until a drawing or diagram of the proposed work to be done is submitted to the City Engineer for his approval and thereafter filed with the City Engineer, and until the filing of a bond in accordance with the provisions of Section 65.613 (below); and in no case less than one thousand dollars conditioned that such work shall be fully and completely finished, in accordance with the approved plat, drawing or diagram, within the period of one year; except, that no bond shall be required for dock construction.

    Application Fee. Before application shall be made as provided above, the applicant shall pay to the City a permit fee of fifty dollars.

    Review and Approval. Upon receipt of the application, together with the bond required herein, the City Engineer shall issue a permit to the applicant allowing the requested dredging and land fill, if in his opinion, the operation meets the requirements set forth in this Chapter and will not adversely affect the maintenance of the average water level of the lake as established over the last ten-year period and will not affect the drainage of water from surrounding lands. The permit shall show the earliest date of commencement and the latest date of completion of the operation and shall be posted by the applicant in a conspicuous place on the job site.

    Restrictions on Permits. All permits granted under this Part shall be subject to any restrictions pertaining to United States navigable waters and other rights common to the public.

    Appeal of Denial of Permit. Any person applying for a permit as provided by this Section, and who is denied issuance of a permit, may appeal the decision of the City Engineer to the City Council.
