§ 65.630. Flood Protection Review Committee.

  • The Flood Protection Review Committee shall hear and decide on requests for appeals of decisions by the Floodplain Administrator and requests for floodplain variances from the strict application of Chapter 63, Part 2C. Pursuant to section 553.73(5), Florida Statutes, the Flood Protection Review Committee shall hear and decide on requests for appeals and requests for floodplain variances from the strict application of the flood resistant construction requirements of the Florida Building Code . The City Council shall hear and decide on requests for appeals of the decisions of the Flood Protection Review Committee.

    (a)

    Establishment. A Flood Protection Review Committee (FPRC) is hereby established which shall consist of:

    1.

    The Public Works Director or designee;

    2.

    The Planning Director or designee;

    3.

    The Chief of Police or designee;

    4.

    The Chief of the Fire Department or designee.

    (b)

    Powers and duties. The powers, duties, and responsibilities of the Flood Protection Review Committee shall be as follows:

    1.

    To hear and decide appeal requests when it is alleged there is an error in any requirement, decision, or determination made by the Floodplain Administrator.

    2.

    To hear and decide applications for variances from the requirements of the Floodplain Regulations and the flood resistant construction requirements of the Florida Building Code .

    3.

    To adopt such rules of procedure as are necessary to carry out its duties as required by this Part.

    4.

    To appoint an Executive Secretary to serve as the custodian of all Committee records, in accordance with City records policies.
