§ 1. Firefighter Pension Fund.
(1)
There is hereby created a fund to be known as the pension fund of the fire department of the City of Orlando. Each member of the Fire Department of said City, as defined by Section 2, (Laws of Fla. ch. 23444(1945), as amended), except those members who are receiving a pension under the provisions of this Act, shall pay into the fund thirteen percent (13%) of his salary each month, the same to be deducted by the Comptroller of the City from said salary and to be deposited by the Comptroller to the credit of the fund in such depository or depositories as the Board of Trustees hereinafter mentioned shall from time to time by order designate, for the purpose of assisting in payment of the benefits to be paid under this Act; provided, however, that if the Board of Trustees of the Pension Fund should find that said thirteen percent (13%) is unnecessary for the operation and performance of the terms and provisions of this Act, the Board, by a majority vote of the members thereof, may reduce the thirteen percent (13%) deduction to such lesser percentage as is reasonably necessary for the operation and performance of the terms and provisions of the terms and provisions of this Act. For the purposes of this Act, "salary" shall mean and include base pay, emergency medical technician (EMT) and paramedic pay, longevity pay, incentive pay, and any fixed monthly remuneration, but shall not include overtime pay, education advancement pay and any other form of compensation not specifically included above.

The City shall pay into the Pension Fund, annually, a sufficient sum of money which, added to revenues received from the levy of the excise tax provided for by Florida Statutes § 175.05, or by any similar statute passed hereafter, or as the same may hereafter be amended, shall amount to five thousand ($5,000.00), and it may lawfully pay into said Pension Fund an additional sum so as to increase the aforesaid amount to ten thousand dollars ($10,000.00). Said sums as are paid by the City shall be paid by the Comptroller who shall deposit same to the credit of the fund in such depository or depositories as the Board of Trustees hereinafter mentioned shall from time to time designate, and shall be for the purpose of providing additional sums necessary above the members' salary contributions heretofore provided for. There shall be paid into the fund to pay the obligations thereof such other contributions as the fund may receive from any source, including earnings on the assets held by the fund, said payments into the fund to be made by deposit to the credit of the fund in such depository or depositories as the Board of Trustees hereinafter mentioned shall from time to time designate. Notwithstanding anything else contained in this section the City may, in its discretion, make the contributions called for under Florida Statutes § 175.09(1)(d), as amended.
