§ 11. Disability Pension—Powers of the Board.

  • (1)

    The Board of Trustees is hereby authorized to issue subpoenas to compel testimony and to issue subpoenas duces tecum to compel production of documents in connection with the hearing and determination of applications for disability pension. Said subpoenas shall be enforceable, and the failure to comply therewith shall be punishable, as provided by the laws of the State of Florida.

    (2)

    The Board of Trustees is hereby authorized to promulgate rules and procedures for the hearing and determination of applications for disability pensions.

    (3)

    Notwithstanding any other provision of this Act, a disability pension may be denied by the Board of Trustees if it is determined that: the applicant is not totally disabled to do all of the functions which can be performed by members of his/her same rank and; the applicant is able to do some of the functions which can be performed by members of his/her same rank and; the chief of the Fire Department is willing to permit the applicant to remain on the Orlando Fire Department, performing limited duty with no reduction in pay.
