§ 13. Refund of Member's Contributions.
(1)
If a deceased member shall not have started receipt of or had his DROP account credited with any pension monies under Section 12, "Service Requirement for Voluntary Retirement"; or Section 18 of this pension act, as amended, and shall leave no surviving spouse, child under the age of eighteen (18) years or dependent parent, then one-half (½) of the amount that has been deducted from said member's salary under this act up to April 20, 1972, the effective date of Laws of Fla. ch. 72-633, § 3, and all of said deductions made thereafter shall be paid as follows:
(a)
Prior to completion of ten (10) years of credited service.
(i)
A Beneficiary of a deceased member who dies prior to completion of ten (10) years of credited service shall receive a refund of one hundred percent (100%) of the member's accumulated contributions without interest.
(ii)
If there is no beneficiary, such refund shall be paid to the member's estate.
(iii)
The refund shall include all of the member's contributions, including those contributions for the basic costs of pension benefits, for the Section 12(3) benefit payable after completion of 20 years of credited service regardless of age, for the Section 19 "Cost of Living Increase" benefit, and for the Section 21, "Deferred Retirement Option Plan" benefit.
(b)
After completion of ten (10) years of credited service.
(i)
A Beneficiary of a Section 34(1)(a) life with 10 years certain option in lieu of the payments of the monthly benefit such beneficiary is entitled to receive as stated in Section 35, "10 Year Certain Guarantee", for the remainder of the 120 monthly payments, may elect to receive a refund of one-hundred percent (100%) of the member's accumulated contributions without interest. The refund shall include all of the member's contributions, including those contributions for the basic costs of pension benefits, for the Section 12(3) benefit payable after completion of 20 years of credited service regardless of age, for the Section 19 "Cost of Living Increase" benefit, and for the Section 21, "Deferred Retirement Option Plan" benefit.
