§ 27. Tax Qualifications, Statutory Minimums, and SHARE Program.
(a)
The legislative body of the City of Orlando is authorized to amend the pension plan to the limited extent necessary to obtain and maintain tax qualification of the plan under the Internal Revenue Code and to comply with mandatory and optional provisions of the Internal Revenue Code applicable to governmental pension plans for firefighters, but must obtain prior agreement of the members and their collective bargaining agent, if any, should such amendments change any plan benefits.
(b)
The legislative body of the City of Orlando is authorized to amend the pension plan to the limited extent necessary to comply with the minimum standards and benefits levels required by Chapter 175, Florida Statutes, in order to allow the plan to receive funds from the Police and Firefighters' Premium Tax Trust Fund, but must obtain prior agreement of the members and their collective bargaining agent, if any, should such required amendments change any plan benefits.
(c)
The legislative body of the City of Orlando is authorized to amend the pension plan to the limited extent necessary to create a SHARE program or plan to provide for extra benefits as required by section 175.351(1), Florida Statutes, funded by additional premium tax revenues, but must obtain prior agreement of the collective bargaining agent of the members.
