§ 43A.05. Sale of Goods or Services at Excessive Prices.
(a)
During any state of emergency declared pursuant to Section 43A.02, it shall be unlawful to sell or offer for sale any goods, services or materials at prices in excess of those prices for the same or similar goods, services or materials that were in existence prior to the date of the Mayor's written proclamation declaring the state of emergency.
(b)
If it can be demonstrated by the offeror or seller that the cost to the offeror/seller of the particular goods, services or materials increased after the date of the Mayor's proclamation and that the price at which those goods, services or materials are offered or sold subsequent to such proclamation is a reasonable reflection of the increased cost to the offeror/seller, such offer or sale shall not be deemed unlawful or prohibited under subsection (a) alone.
(c)
The prohibitions contained in this section shall not apply to any person initially doing business in the City after the date of the Mayor's proclamation if the prices at which such person sells or offers for sale are no more than the prevailing price charged for goods, services or materials effective in the City prior to the date of the Mayor's proclamation.
