§ 61.304. Paving Requirements.

  • (a)

    General Requirements. All parking lots, loading areas and vehicular use areas shall have a durable all-weather surface with drainage and surface water control as required by the City Engineer, and shall be continually maintained in satisfactory condition so as to be safe, attractive and free of hazard, nuisance or other unsafe conditions. For purposes of this Section, a durable all-weather surface shall mean an improved surface of concrete, brick, asphalt, open weave paver blocks (for one- or two-family dwellings only), or other permanent dust-free surfaces, but shall not include wood chips, mulch or other material subject to decay.

    (b)

    Stone Parking Lots. Stone may be requested as an alternative surface for vehicle use areas in accordance with the following requirements:

    (1)

    Stone surfaces shall require approval by the City Engineer and shall be maintained per City Engineering standards.

    (2)

    Stone surfaces may be approved as modification of development standards by the Zoning Official and City Engineer in the following locations:

    a)

    within the root zone of existing trees; or

    b)

    on legally existing, non-conforming parking spaces and driveways which do not meet the conditions of Section 61.304 (a) above; or

    c)

    where the available area is limited in size such that is makes construction of a paved parking surface (and the accompanying storm water facilities) technically impractical and it serves five or less parking spaces, notwithstanding ADA standards.

    (3)

    To ensure that nuisances and safety hazards will not be created by the spilling of stone onto sidewalks and streets, stone shall not be used on any vehicular use area within 15 feet of a street right-of-way. Furthermore, a 6 inch curb or other suitable means is required to contain stone on the site.

    (4)

    Lime rock, lava rock and similar materials shall not be considered acceptable stone surfaces.

    (5)

    Coarse aggregate, such as gravel, smaller than standard size #4 (in accordance with the Florida Department of Transportation Standard Specifications for Road and Bridge Construction, Section 901) shall not be permitted.

    (6)

    Minimum depth of stone is 4 inches.

    (c)

    Unimproved Parking. The planning official may approve unimproved off-street parking spaces and vehicular use areas for:

    (1)

    Occasional Parking: Up to 40% of the minimum required number of parking spaces, where the parking lot is to be used for occasional parking only (one to two times per week), and provided that all accessways and aisles shall be paved.

    (2)

    Temporary or Interim Non-Residential Parking: Up to 100% of the minimum required number of parking spaces, where the parking lot will be used on only a temporary or interim basis (not more than 180 days, unless approved by City Council for a longer period).

    (3)

    Tree Protection: Up to 15% of the minimum required number of spaces, for protection of existing trees in accordance with the requirements of Chapter 60.

    (d)

    Required Conditions for Unimproved Parking. No unimproved parking shall be approved unless the following conditions are met:

    (1)

    The unimproved parking area shall be shown on the final site plan.

    (2)

    The property owner shall at his own expense enter into a written agreement with the City, recorded in the public records of Orange County and running with the land, that the unimproved parking area shall never be encroached upon, used, sold, or leased for any purpose other than parking for the use it serves so long as the parking spaces are required by this Part.

    (3)

    The written agreement shall include such conditions as may be necessary to guarantee development of the unimproved parking area whenever the planning official determines that the need exists or that the unimproved parking area has not been maintained in a healthy, grassy state. The agreement shall be voided if the unimproved parking area is developed as a parking facility, or if the parking spaces are no longer required by this Part.
