§ 65.141. Board Duties, Powers, and Responsibilities.
Acquire Information. The Municipal Planning Board shall acquire and maintain information and materials necessary to understand the trends and conditions causing change in the Orlando area. This may include maps, photographs, population statistics, demographic data, property values, economic data, land use information, and other information important in determining the amount, location, and type of development to be expected in the City.
Designation as Local Planning Agency. Pursuant to section 163.3174, Florida Statutes, the Municipal Planning Board is hereby designated and established as the local planning agency for the City of Orlando.
Duties as Local Planning Agency. In accordance with the Local Government Comprehensive Planning and Land Development Regulation Act, the Municipal Planning Board shall:
(a)
Be responsible for the preparation of the Growth Management Plan or amendments thereto, and shall make recommendations to the City Council regarding the adoption or amendment thereof.
(b)
During the preparation of the plan or plan amendments and prior to any recommendation to the City Council, the Municipal Planning Board shall hold at least one public hearing, with public notice, on the proposed plan or plan amendment.
(c)
Monitor and oversee the effectiveness and status of the Growth Management Plan and recommend to the City Council such changes in the Growth Management Plan as may from time to time be required, including preparation of the periodic reports required by section 163.3191, Florida Statutes.
(d)
Perform any other functions, duties, and responsibilities assigned to it by the City Council or by general or special law.
Designation as Land Development Regulation Commission. Pursuant to sections 163.3164(22) and 163.3174(4)(c), Florida Statutes, as may be amended from time to time, the Municipal Planning Board is hereby designated as the land development regulation commission for the City of Orlando.
Duties as Land Development Regulation Commission. In accordance with the Local Government Comprehensive Planning and Land Development Regulation Act, the Municipal Planning Board shall:
(a)
Develop and recommend, to the City Council, land development regulations and land development codes, or amendments thereto, that implement the Growth Management Plan.
(b)
Review land development regulations and land development codes, or amendments thereto, for consistency with the Growth Management Plan and report to the City Council regarding its findings.
Recommend Capital Improvements. Each year the Municipal Planning Board shall submit to the City Council, at least 90 days before the beginning of the budget year, a list of recommended capital improvements necessary or desirable to the implementation of the Growth Management Plan. At a minimum, the list must include the following:
(a)
Identification of a recommended financing method for each project.
(b)
The recommended priority level of each project.
(c)
Recommendations for at least the subsequent 5 year period.
Advice Regarding Planning and Zoning. The Municipal Planning Board shall keep the City Council and the public informed and advised on matters relating to planning and zoning, and the City Council may seek information and advice from the Municipal Planning Board on planning and zoning related matters.
Conduct Public Hearings. The Municipal Planning Board shall conduct public hearings when required by the Land Development Code or by general or special law. When hearings are held on applications for development orders, the hearing must be held before the Municipal Planning Board makes a recommendation on the application to the City Council. When a public hearing before the Municipal Planning Board is required by the Land Development Code or by general or special law, the hearing must occur before City Council takes final action on the respective application.
Review of Recommendations by Other Boards. The Board shall review and make final recommendations to the City Council concerning recommendations on development orders by the Downtown Development Board, Historic Preservation Board, Board of Zoning Adjustment and other boards, wherever the development order involves recommendations from more than one board. When required by the Land Development Code or by general or special law, the Municipal Planning Board shall review recommendations made by other boards, commissions, committees, or other bodies, prior to the recommendation being presented to the City Council.
Appeals. The Municipal Planning Board shall hear and decide appeals when required by the Land Development Code or by general or special law.
Special Studies. The Municipal Planning Board may conduct or obtain special studies on the location, condition, and adequacy of public and private facilities and improvements within the City, including, without limitation, housing facilities, commercial and industrial facilities, parks, playgrounds, and other recreational facilities, schools, and other public buildings, public and private utilities, transportation and parking facilities, and may also conduct or obtain special studies on urban design and architecture.
Miscellaneous. The Municipal Planning Board shall perform other duties as assigned by the City Council, Mayor, or Planning Official.
