§ 65.255. Considerations for Review of Application for Development Approval.

  • The review of the Application for Development Approval shall result in recommendations for the Application for Development Approval in the form of a recommended Development Order. In addition, approval of the Master shall include conditions which are not part of the Development Order, but shall include consideration of issues of local concern. In the review of Application for Development Approval, the Municipal Planning Board and City Council shall include the consideration of the following factors:

    Florida Statutes ch. 380. Whether the request is consistent with the requirements of Florida Statutes ch. 380 and the State Land Development Plan.

    Regional Planning Council Recommendations. Whether the request is consistent with the East Central Florida project Review Committee recommendations, as approved.

    Growth Management Plan. Whether the request is consistent with all applicable policies of the City's adopted Growth Management Plan.

    Conformance with this Chapter. Whether the request is in conformance with any applicable substantive requirements of this Chapter.

    Land Use Compatibility and Current County Zoning. Whether and the extent to which the request would result in any incompatible land uses, considering the type and location of uses involved.

    Adequate Public Facilities. Whether and the extent to which the request would result in demand on public facilities and services (both on-site and off-site), exceeding the capacity of such facilities and services, existing or programmed, including transportation, utilities, drainage, recreation, education, emergency services, and similar necessary facilities and services.

    Other Matters. Any other matters which they may deem relevant and appropriate.
