§ 65.265. Considerations for Review of Annexation and Initial Zoning Requests.

  • In the review of Annexation & Initial Zoning requests, the Municipal Planning Board and City Council shall include the consideration of the following factors:

    Florida Statutes ch. 171. Whether the request is consistent with the requirements of Florida Statutes ch. 171, including requirements that the area proposed for annexation be contiguous to the City boundaries, be reasonably compact, and meet all other requirements of state law.

    Growth Management Plan. Whether the request is consistent with all applicable policies of the City's adopted Growth Management Plan.

    Conformance with this Chapter. Whether the request is in conformance with any applicable substantive requirements of this Chapter, including minimum or maximum district size.

    Land Use Compatibility and Current Adjacent Zoning. Whether and the extent to which the request would result in any incompatible land uses, considering the type and location of uses involved. The current comprehensive plan and zoning designations of the property and adjacent parcels of land shall be considered.

    Adequate Public Facilities. Whether and the extent to which the request would result in demand on public facilities and services (both on-site and off-site), exceeding the capacity of such facilities and services, existing or programmed, including but not limited to transportation, utilities, drainage, recreation, education, emergency services, and similar necessary facilities and services.

    Other Matters. Any other matters which they may deem relevant and appropriate.
