§ 65.264. The Review Process.

  • City Council Action. Upon acceptance of the application, copies of the Petition for Annexation and supporting materials shall be presented to the City Council. The Council will take action to refer the Petition to the Municipal Planning Board. The Planning and Development Department shall initiate the review of the application.

    Technical Review Committee. Copies of the application for annexation/initial zoning shall be forwarded to all members of the Technical Review Committee for review. The Planning and Development Department will review the application for consistency with the requirements of State Law, the Provisions of this Part, and all other applicable provisions. The Technical Review Committee (TRC) shall meet to review the application, and the applicant or his representative should also be present at the meeting. Following the meeting, the TRC shall prepare recommendations for the consideration of the Municipal Planning Board.

    Municipal Planning Board. The Municipal Planning Board shall hold a public hearing with due public notice to consider the application. Based upon the application, the requirements of this Chapter, the provisions of Florida Statutes ch. 171, and the recommendations of staff, the Board shall make a recommendation to approve, deny, approve with modifications or conditions, or refer the matter back to the TRC for further consideration based on specific instructions.

    City Council Review. The recommendations of the Municipal Planning Board shall be submitted to the City Council for final review and approval or denial. The City staff shall initiate the preparation of the necessary ordinances. The City Clerk shall schedule and advertise the ordinances for legal hearings to be held by City Council. City Council shall hold two (2) legal hearings/readings of the ordinances. Upon completion of the second reading and adoption, the ordinance shall become effective as set out therein.
