§ 65.293. The Review Process.
Technical Review Committee. Upon acceptance of the application, copies shall be forwarded to all members of the Technical Review Committee (TRC). The TRC shall meet to review the application, and the applicant or his representative should also be present at the meeting. Following this meeting, the TRC shall prepare recommendations for the consideration of the Municipal Planning Board.
Request for Additional Information (if Necessary). If the TRC finds that additional information is needed for the proper review of the application, the Planning Official shall notify the developer within 15 days following the TRC meeting, specifying the information needed. Submittal and review of such information shall be the same as for the original application.
Municipal Planning Board. Following review by the TRC, a Public Hearing with due public notice shall be held before the Municipal Planning Board to consider the Development Plan. This hearing may be continued from time to time as necessary to facilitate such changes, conditions and additions in the Development Plan as may be agreed upon by the Municipal Planning Board and the applicant. Based on the recommendation of the TRC and the Development Plan finally agreed to by the applicant, the Board shall prepare recommendations for the consideration of the City Council to approve, approve with further amendments or additions to the Development Plan, or deny the application.
City Council. Following review by the Municipal Planning Board, a Public Hearing shall be held before the City Council.
Based on the application as amended and the recommendations of the Board, the City Council shall approve, approve with whatever amendments or additions to the Development Plan it deems necessary and appropriate, or deny the application. Should the applicant not agree with a Development Plan in the form in which it is approved by the City Council, the application may be withdrawn at any time prior to the adoption of the ordinance enacting the rezoning to the PD district.
Re-Application Time Limits. The rezoning of property to the PD district based on a particular Development Plan shall operate to prohibit the consideration by the Municipal Planning Board of any new application for rezoning (excluding an application to amend the approved Development Plan) for any part of such property for a period of 12 months from the date of the rezone. Neither the denial of an application to rezone to the PD district, nor the withdrawal of such petition shall operate to deny the applicant consideration of a new rezoning application at any time, except that no new application to rezone to the PD district may be considered by the Municipal Planning Board within a period of 12 months from the date of such denial or withdrawal. The denial of an application to rezone to a category other than Planned Development shall not operate to prohibit the filing of an application for PD zoning at any time.
