§ 65.307. Appeals.

Whenever the applicant disagrees with the decision of the Zoning Official or any of the conditions imposed as part of the terms under which the Modification of Standards is approved, he may elect to appeal the application to the Board of Zoning Adjustment. The appeal shall be reviewed by the Board of Zoning Adjustment as set forth by this Part. The Board of Zoning Adjustment shall consider the appeal and hear any concerned person or party. Following the hearing, the Board of Zoning Adjustment shall render its decision; approving, approving with conditions, or denying the appeal.
