§ 65.522. Certificate of Separation Required Prior to Issuance of Building Permit or Other Permit.

  • A Certificate of Separation must be issued by the Zoning Official prior to the issuance of any building permit or any other permit required for construction, alteration, or occupancy. Each application for a Certificate of Separation shall contain such information and be accompanied by such surveys, plats, drawings, and other data as may be necessary to enable the Zoning Official to determine whether or not the proposed site of the community residential home will comply with all applicable zoning regulations.

    When a site for a community residential home has been selected by a sponsoring agency in an area zoned for multi-family development, the agency shall notify the Chief Executive Officer of the City of Orlando in writing and include in the notice the specific address of the site, the residential licensing category, the number of residents, and the community support requirements of the program. Such notice shall also contain a statement from the District Administrator of the Department (HRS) indicating the need for and the licensing status of the proposed community residential home and how the home meets applicable licensing criteria for the safe care and supervision of the clients in the home. The District Administrator shall also provide to the City of Orlando the most recently published data compiled that identifies all community residential homes in the district in which the proposed site is to be located.

    Homes with six or fewer residents which otherwise meet the definition of a community residential home shall not be required to comply with the notification provisions of this Section; provided, however, that the sponsoring agency or the department notifies the local government at the time of home occupancy that the home is licensed by the department.
