§ 65.533. Individual Development Approval Review Process.

  • In addition to any other review process required by this Code or other authority, each application for Individual Development Approval shall undergo administrative review by the Department to ensure availability of development capacity under the DDRI.

    A Certificate of Individual Development Approval shall be issued within 15 working days after a complete and sufficient application is submitted if adequate development capacity remains for the proposed use. If there is insufficient development capacity under the DDRI, the applicant shall be informed in writing within 15 days of the available capacity and the possibility of conversion of other use capacities as set forth below.

    Issuance of a Certificate of Individual Development Approval shall entitle the applicant to seek a building permit under the provisions of this Code consistent with and encompassing all development approved in the Certificate. The Certificate and all rights appurtenant thereunder shall be specific to the site and application as proposed and approved.

    If the development proposed in the building permit application varies from that approved in the Certificate, the developer must submit an amended application for Individual Development Approval. Such an amended application would require the payment of an amendment fee in an amount to be set from time to time by resolution of the City Council, as well as any additional application fee required for increased capacity.

    The development rights under the Individual Development Approval shall remain in full force and effect so long as a building permit is issued within twelve (12) months of the issuance of the Certificate; however, expiration or cancellation of said building permit under the provisions of this Code shall simultaneously terminate the Individual Development Approval and all rights thereunder.
