§ 7. Board of Adjustment Created.

  • There is hereby created a Board of Adjustment consisting of seven (7) members, and up to two alternative members, who shall be residents and taxpayers of the City of Orlando and who shall not at the same time serve as members of the Municipal Planning Board. The terms, duties and functions of said Board of Adjustment shall be defined by ordinance but in general said Board of Adjustment shall hear appeals from rulings of the Zoning Administrator relating to the Enforcement of the zoning ordinance; permit extension of a district where the boundary line divides a lot in single ownership; and in general so interpret the ordinances of said City regulating height and area of buildings and zoning classifications as to avoid unnecessary hardships and practical difficulties in particular cases under criteria established by ordinance. In all events such Board of Adjustment shall perform such duties as are assigned to it by ordinance. The City Council may prescribe rules and regulations and fix fees to be paid by persons conducting appeals to the Board of Adjustment and the manner of appeals from decisions of the Board. The Board of Adjustment may be abolished or its duties, responsibilities and membership may be diminished, increased, amended, altered or changed by ordinance.
