Chapter 39. ORLANDO TRAFFIC AND PARKING CODE |
Article III. TRANSPORTATION ENGINEERING BUREAU |
§ 39.08. Special Duties.
The Transportation Engineering Bureau Chief or his designee is authorized to:
(1)
Determine and designate certain streets as one-way and promulgate, adopt and amend schedules naming such streets and erect appropriate signs giving notice thereof.
(2)
Implement traffic regulations to cover emergency, hazardous or special conditions and place and maintain traffic-control devices as he deems necessary to regulate traffic or warn the public.
(3)
Make temporary rules regulating traffic and on-street parking outside the Downtown Area or testing traffic-control devices under actual conditions of traffic. Such rules regulating traffic may remain in effect for up to one hundred twenty (120) days; provided, however, that such period may be extended by action of City Council for a period not to exceed two (2) years. Such rule shall not be binding upon the public unless indicated by appropriate signs or under the personal direction of a police officer.
(4)
Determine the location of passenger loading zones and on-street parking outside the Downtown Area and place and maintain appropriate signs indicating the same and stating the hours during which the provisions of this section are applicable. The Transportation Engineering Bureau Chief shall not designate or mark any such zone upon special request of any person, unless such person makes application for a permit for such zone and for two (2) signs to indicate the ends of each such zone.
(5)
Establish bus stops and taxi stands for passenger common carrier motor vehicles, including taxicabs, on the public streets, in such places and in such number as he shall determine to be of the greatest benefit and convenience to the public. Every such bus stop or stand for passenger common carrier motor vehicles shall be designated by appropriate signs. A service fee may be imposed, in accordance with a schedule adopted by the City Council, under this section upon the operator of any such bus or other passenger common carrier motor vehicle for the privilege of using such stop or stand; provided, however, that nothing herein contained shall be deemed to affect in any manner the provisions of Chapter 55 of this Code.
(6)
Determine and designate certain streets as "through streets" and promulgate, adopt and amend schedules naming such streets. When such determination is made, the Transportation Engineering Bureau Chief or his designee shall place and maintain a traffic-control device on each and every street intersecting such "through street" or that portion thereof described and designated as such.
(7)
Determine and designate where particular hazards exist at intersections with other than through streets and require that vehicles shall stop or yield at one or more entrances to any such intersection, by a stop or yield sign, or in the event he determines that reduced speed rather than a stop is adequate for safe operation at any such intersection, he shall determine such safe speed by engineering investigation, and shall provide signs upon the approaches to such intersection giving notice of such speed.
(8)
Mark and maintain lanes or zones for traffic on streets at such places as he may deem advisable for safety and for expediting traffic, either vehicular or pedestrian.
(9)
Determine those intersections and other locations at which drivers of vehicles shall not make a right, left, or "U" turn, and shall place proper signs at such intersections or locations.
(10)
Issue a special permit for specific vehicles to be operated, driven or parked on Wall Street between Orange Avenue and Court Street subject to certain terms and conditions as specified in the permit if, in the Transportation Engineering Bureau Chief's determination, such privilege is reasonably necessary in the conduct of an abutting property owner's business or for a special event or circumstance, and such privilege will not create an unreasonable safety hazard.
(11)
Recommend geometric improvements to roadways and intersections to improve traffic flow and safety and implement or test such improvements to correct traffic safety hazards.
(12)
Implement truck routes, through truck restrictions and weight limit restrictions for City maintained roadways and intersections, as determined by engineering studies. All recreational vehicles/trailers shall be exempt from weight limit restrictions.
(13)
For streets outside the Downtown Area, the Transportation Engineering Bureau Chief shall determine the location of on-street freight loading zones and place and maintain appropriate signs indicating the same and stating the hours during which same are in effect. The Transportation Engineering Bureau Chief shall not designate or mark any such zone upon special request of any person unless such person makes application for a permit for such zone and for two (2) signs to indicate the ends of each such zone.
(14)
Outside the Downtown Area, the Transportation Engineering Bureau Chief shall determine and designate whether or not parking shall be allowed upon one or both sides of any street, the parking time or limitations or promulgate, adopt and amend schedules designating parking limitations and shall erect, place and maintain signs, devices or markings giving notice thereof.
(15)
Coordinate with residential/neighborhood groups and associations any written request for a residential parking permit program, determined by field study as necessary, to regulate on-street parking in residential neighborhoods.
(16)
Install and maintain regulatory, warning and informational signing determined by the Transportation Engineering Bureau Chief as necessary to maintain the safe and efficient movement of pedestrians, bicycles, and motor vehicles over City maintained right-of-way.
(17)
Review applications and other requests for use or closure of sidewalks, traffic lanes and streets, set conditions for same, and authorize or deny street, lane, or sidewalk use or closure accordingly. The fee for such use or closure authorization shall be established by Resolution of City Council. The Transportation Engineer shall determine the impact of events on adjacent sidewalks, traffic lanes and streets and shall require and authorize a street, lane, or sidewalk closure if such impact would necessitate closure in order to assure the safety of vehicular and/or pedestrian movement in the area. The Transportation Engineer shall also recommend approval or disapproval of, or modification to, proposed plans affecting City-maintained right-of-way. The Transportation Engineering Bureau Chief shall determine the appropriate manner to maintain traffic through detours, signs, barricades, temporary pavement markings, traffic signal control modifications and the use of law enforcement officers.
For the purpose of this section, the term "closure" shall mean and include erection of barricades and appropriate signage to divert traffic for a specified length of time. The term shall not include a "roving roadblock" which occurs when police officers temporarily block a roadway for a short period of time.
(18)
Review all construction plans and building permits with existing or proposed pedestrian or vehicular access on or across the public right-of-way for compliance with applicable codes and standards for access management and issue variances from standards when justified by physical constraints or engineering study.
