§ 65.397. Factors to be Considered in the Review of Growth Management Plan Amendment Application.
In their review of Growth Management Plan Amendment applications, the Municipal Planning Board and City Council shall consider the following factors:
State Comprehensive Plan (Florida Statutes ch. 187). Whether the request is consistent with the State Comprehensive Plan (Florida Statutes ch. 187).
East Central Florida Comprehensive Regional Policy Plan. Whether the request is consistent with the East Central Florida Comprehensive Regional Policy Plan.
F.A.C. ch. 9J-5. Whether the request is consistent with the provisions of F.A.C. ch. 9J-5.
Florida Statutes ch. 163, pt. II. Whether the request is consistent with the provisions of Florida Statutes ch. 163, pt. II.
Growth Management Plan. Whether the request is consistent with all the applicable policies of the City's adopted Growth Management Plan.
Changed Conditions. Whether and the extent to which land use and development conditions have changed since the adoption of the Growth Management Plan.
Land Use Compatibility. Whether and the extent to which the proposal would result in any incompatible land uses, considering the type and location of uses involved.
Adequate Public Facilities. Whether and the extent to which the proposal would result in demands on public facilities and services (both on-site and off-site) exceeding the capacity of such facilities and services, existing or programmed, including transportation, utilities, drainage, recreation, and similar facilities and services. A concurrency evaluation shall be conducted as part of any application for a Growth Management Plan amendment which would increase the intensity or density of development permitted, in accordance with Section 59.301 of the Land Development Code.
Other Matters. Any other matters which they may deem relevant and appropriate.
