§ 65.482. The Review and Adoption Process.

  • Staff Review. The Planning Official shall begin the processing of a proposed Land Development Code text amendment by gathering appropriate information and data, conducting any necessary study, and drafting proposed amendment language with the City Attorney. During this process the Planning Official may, as he or she deems advantageous, seek advice from appropriate interested parties such as the several departments of the City, utility providers, neighborhood and homeowner associations, government agencies, regulated industries, and other relevant stakeholders. After completing this process, the Planning Official shall present a report concerning the proposed amendment to the Municipal Planning Board. At a minimum the report must include proposed amendment language or concepts sufficiently developed to give the Municipal Planning Board adequate information on which to make a Growth Management Plan consistency recommendation to the City Council. The Planning Official's report may also include one or more of the following:

    (a)

    A recommendation of whether the proposed text amendment is consistent with the Growth Management Plan.

    (b)

    A recommendation of whether the proposed text amendment is consistent with the public health, safety, and welfare.

    (c)

    A recommendation of whether the proposed text amendment will likely result in compatible or incompatible land uses.

    (d)

    A recommendation of whether the proposed text amendment will likely result in orderly and logical development patterns.

    Municipal Planning Board Review. Upon presentation of the Planning Official's report, the Municipal Planning Board shall hold a public hearing on the proposed amendment at a regularly scheduled meeting of the Municipal Planning Board. The Municipal Planning Board shall consider relevant evidence, including public testimony. After review and consideration the Municipal Planning Board shall recommend to the City Council whether the proposed Land Development Code amendment is consistent or not with the Growth Management Plan. The Municipal Planning Board may also make one or more of the following recommendations to the City Council:

    (a)

    Whether the proposed text amendment is consistent with the public health, safety, and welfare.

    (b)

    Whether the proposed text amendment will likely result in compatible or incompatible land uses.

    (c)

    Whether the proposed text amendment will likely result in orderly and logical development patterns.

    City Council Review and Adoption. After receipt of the Planning Official's report and the Municipal Planning Board's recommendation, the City Council shall determine whether the proposed amendment is consistent with the Growth Management Plan. If the proposed amendment is found to be consistent with the Growth Management Plan, and after consideration of the factors found in section 65.483, the Mayor or the City Council may direct staff to present an ordinance incorporating the proposed text amendment. The City Council shall consider and adopt the ordinance in accordance with the City Code and general or special law.
